A RESOLUTION APPROVING A CHANGE ORDER TO THE OPERATIONS AND MAINTENANCE AGREEMENT FOR THE GROVE PLAZA, BY AND BETWEEN THE CITY OF BOISE CITY, AS OWNER OF THE PLAZA, AND THE GREATER BOISE AUDITORIUM DISTRICT, AS PROVIDER OF OPERATIONAL AND MAINTENANCE SERVICES FOR THE PLAZA; AUTHORIZING THE MAYOR AND CITY CLERK, RESPECTIVELY, TO EXECUTE AND ATTEST THE CHANGE ORDER TO THE OPERATIONS AND MAINTENANCE AGREEMENT; AND PROVIDING AN EFFECTIVE DATE.

Financial Impact

The Grove Plaza Maintenance Agreement cost $13,000 more than expected due to additional snow removal.

Body

              WHEREAS, by deed recorded October 10, 2018, the city of Boise City (“City”) obtained ownership of that parcel of real property known as the “Grove Plaza” at which time the Grove Plaza 2017-2018 Operations and Maintenance Agreement (“Agreement”) managed various maintenance and operational tasks; and             

 

WHEREAS, in Resolution No. 504-18, which was adopted by the City on October 23, 2018, the Operations and Maintenance Agreement for the Grove Plaza, the City agreed to assume the obligations of the Capital City Development Corporation (“CCDC”), which formerly owned the Grove Plaza; and

 

WHEREAS, CCDC received certain Grove Plaza operational and maintenance services from the Greater Boise Auditorium District (“GBAD”) pursuant to the Agreement. GBAD continued work under the Agreement pursuant to the City and GBAD entering into the Agreement; and

 

WHEREAS, GBAD continued to provide services to the City at the Grove Plaza pursuant to the Agreement. However, GBAD’s provision of snow removal exceeded the amount contemplated in the original agreement, which resulted in an increased cost outlined in Exhibit A, Change Order No. 1; and

 

WHEREAS, City staff recommend approval of Change Order No. 1 of the Grove Plaza 2017-2018 Operations and Maintenance Agreement.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:

 

              Section 1.              That Change Order No. 1 to the Grove Plaza 2017-2018 Operations and Maintenance Agreement, attached hereto and incorporated herein by reference, hereby is approved as to form and content.

 

              Section 2.              That the Mayor and City Clerk, respectively, hereby are authorized to execute and attest Change Order No. 1 for and on behalf of the city of Boise City.

 

              Section 3.              That this resolution shall be in full force and effect immediately upon its adoption and approval.
