A RESOLUTION (SOS19-00009) VACATING PLAT NOTE 6 AND MODIFYING PLAT NOTE 8 OF THE ELIZABETH PLACE SUBDIVISION, AS RECORDED WITH THE ADA COUNTY RECORDER IN BOOK 100 OF PLATS AT PAGE 13099 AND LOCATED AT 2700 N SUNSET AVENUE, BOISE, ADA COUNTY; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, on August 20, 2019, the Council of the city of Boise City held a hearing on the vacation of plat note 6 and a modification of plat note 8 of the Elizabeth Place Subdivision removing the requirement that Lot 1, Block 2 be owned and maintained by the Elizabeth Place Homeowners Association, as recorded with the Ada County Recorder in Book 100 of Plats at Page 13099, and located at 2700 N Sunset Avenue, Boise, Ada County; and

              WHEREAS, any and all affected property owners were notified of the proposed vacation, in accordance with Idaho Code § 50-1306A; and

              WHEREAS, after the hearing on August 20, 2019, the Council by formal motion did approve the vacation of plat note 6 and a modification of plat note 8 of the Elizabeth Place Subdivision, removing the requirement that Lot 1, Block 2 be owned and maintained by the Elizabeth Place Homeowners Association, as recorded with the Ada County Recorder in Book 100 of Plats at Page 13099, and located at 2700 N Sunset Avenue, Boise, Ada County.

 

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:

 

              Section 1.  That plat note 6 of the Elizabeth Place Subdivision be vacated and plat note 8 be modified, to no longer require Lot 1, Block 2 be owned and maintained by the Elizabeth Place Homeowners Association, as recorded with the Ada County Recorder in Book 100 of Plats at Page 13099, and located at 2700 N Sunset Avenue, Boise, Ada County.

              Section 2.  That this Resolution shall be in full force and effect immediately upon its adoption and approval.
